Libertad de expresión vs. derecho de autor. Análisis de ponderación de derechos en la Sentencia 1/2017 (México)

    La Sentencia 1/2017 resuelta por la Segunda Sala de la Suprema Corte de Justicia de la Nación (SCJN) en México estudió la imposición de una medida cautelar ordenada por el Instituto Mexicano de la Propiedad Industrial (IMPI) respecto del bloqueo total de una página de internet que ponía a disposición obras musicales sin autorización de sus autores y titulares de derechos para salvaguardar sus derechos en tanto se resolviera el procedimiento de solicitud de infracción en materia de comercio iniciada por la Sociedad de Autores y Compositores de México, S.G.C. (SACM) y otros; se debatían los derechos fundamentales de “libertad de expresión” frente a “la protección a los derechos de autor”. La sentencia determinó que prevalecía la libertad de expresión, entonces, mediante en el presente artículo se hace un análisis de dicha sentencia a la luz la argumentación jurídica como discurso racional de Robert Alexy, usando su fórmula de peso y variables para la ponderación de los derechos que se contraponen, determinando si la sentencia podría haber sido diferente considerando los factores del caso o si se confirma la determinación.

    Judgment 1/2017, resolved by the Second Chamber of the Supreme Court of Justice of the Nation (SCJN) in Mexico, examined the imposition of a precautionary measure ordered by the Mexican Institute of Industrial Property (IMPI) regarding the total blocking of an internet page that made musical works available without authorization from their authors and rights holders to safeguard their rights while the infringement proceedings initiated by the Society of Authors and Composers of Mexico, S.G.C. (SACM) and others were resolved; thus, the fundamental rights of “freedom of expression” versus “protection of copyright” were debated. The verdict determined that freedom of speech prevailed, so this article analyzes said judgment considering the legal argumentation as a rational discourse by Robert Alexy, using his weighting formula and variables for the balancing of conflicting rights, determining whether the judgment could have been different considering the factors of the specific case or if the determination of the SCJN is confirmed.
