    Il saggio affronta il tema delle fattispecie rispetto alle quali, in passato come in tempi recenti, si è posto il problema di riconoscerle o meno quali soggetti di diritto. L’analisi prende in considerazione figure eterogenee – dai patrimoni destinati al nascituro, dagli animali alla natura, sino alle forme di intelligenza artificiale – ricostruendo il dibattito dottrinale e giurisprudenziale che si è sviluppato intorno a ciascuna di esse. L’indagine non si limita a fornire una mappa delle soluzioni proposte, ma cerca di coglierne le ragioni profonde: da un lato le spinte che hanno favorito l’attribuzione di soggettività, dall’altro le argomentazioni volte a negarla. In tal modo, il contributo intende gettare le basi per una riflessione critica sulla categoria giuridica della soggettività e sui suoi confini, evidenziandone i presupposti teorici e le possibili linee evolutive.

    The essay addresses the issue of cases in which, both in the past and in recent times, the question of whether or not to recognize them as legal entities has arisen. The analysis takes into consideration a variety of figures – from assets intended for the unborn, to animals, to nature, to forms of artificial intelligence – reconstructing the doctrinal and jurisprudential debate that has developed around each of them. The investigation does not merely provide a map of the proposed solutions, but seeks to grasp their underlying reasons: on the one hand, the forces that have favored the attribution of subjectivity, and on the other, the arguments aimed at denying it. In this way, the contribution aims to lay the foundations for a critical reflection on the legal category of subjectivity and its boundaries, highlighting its theoretical assumptions and possible lines of evolution.
