La oralidad en la justicia mercantil: justicia ciudadanizada

    Este artículo aporta una reflexión acerca de la oralidad en la justicia mercantil, enfocándose en la justicia ciudadanizada, un modelo en el que las personas involucradas en la contienda jurídica tienen una participación activa durante el procedimiento y el juez cumple con el principio de inmediación. Se trata de una investigación con enfoque cualitativo que utiliza el método exegético y argumentativo. En un primer momento, se aborda el derecho de acceso a la justicia, identificando la tutela judicial objetiva. En un segundo momento, se analiza el sistema de justicia mercantil a través del juicio oral mercantil, conforme a las reformas de 2011 y 2017 al Código de Comercio mexicano. El objetivo es describir las fases del procedimiento oral mercantil y su articulación con los principios del sistema, para justificar cómo, a través de estos principios, se impulsa la confianza y se obtienen resoluciones con mayor economía, en una justicia pronta y expedita que reduce los costos tanto para los contendientes como para el Estado. En suma, la proximidad de las partes en la contienda jurídica y la actuación de los jueces devuelven a los ciudadanos su derecho a ser oídos, propiciando una justicia ágil y transparente que permanece cercana a los ciudadanos.

    This article provides a reflection on orality in commercial justice, focusing on citizen-based justice, a model in which the individuals involved in the legal dispute play an active role during the procedure, and the judge adheres to the principle of immediacy. It is a qualitative research study using the exegetical and argumentative method. First, the right of access to justice is addressed, identifying objective judicial protection. Second, the commercial justice system is analyzed through the commercial oral trial, in line with the 2011 and 2017 reforms to the Mexican Commercial Code. The aim is to describe the phases of the commercial oral procedure and its articulation with the system’s principles, to justify how, through these principles, trust is fostered, and decisions are obtained with greater efficiency, in prompt and expedient justice that reduces costs for both the litigants and the State. In summary, the proximity of the parties in the legal dispute and the actions of the judges restore the citizens’ right to be heard, promoting swift and transparent justice that remains close to the people.
