Dimensión del derecho de libertad religiosa, de asociación, de igualdad y de no discriminación por razón de sexo, a propósito de la sentencia del Tribunal Constitucional 132/2024, de 4 de noviembre de 2024

    A lo largo de las páginas de este trabajo, se pone de manifiesto el cambio de planteamiento producido por la Sentencia 132/2024, de 4 de noviembre, del Tribunal Constitucional, en relación con la solicitud de una ciudadana de modificar el art. 1 de los estatutos de la Pontificia Real y Venerable Esclavitud del Santísimo Cristo de La Laguna, al considerar que al producirse la exclusión de las mujeres de formar parte de la citada asociación se vulneraba el derecho de igualdad, no discriminación por razón de sexo y el derecho de asociación. El Tribunal Constitucional considera que se produce una vulneración del derecho a la no discriminación por razón de género y su derecho de asociación, recogidos en los arts. 14 y 22 de la Constitución, y declara la nulidad de la Sentencia 925/2021, de 23 de diciembre, del Tribunal Supremo, y, en este sentido, procederemos a analizar los motivos aducidos por este Tribunal.

    Throughout this work, the change in approach brought about by Constitutional Court Judgment 132/2024, of November 4th, is highlighted. This judgment addresses a citizen’s request to amend Article 1 of the statutes of the Pontifical Royal and Venerable Slavery of the Most Holy Christ of La Laguna. This ruling considers that the exclusion of women from membership in the aforementioned association violates the right to equality, non-discrimination based on sex, and the right to association. The Constitutional Court finds that there has been a violation of the right to non-discrimination based on gender and the right to association, as enshrined in Articles 14 and 22 of the Constitution, and declares the nullity of Supreme Court Judgment 925/2021, of December 23th. In this regard, we will analyze the reasons given by this court.
