    El artículo analiza el reconocimiento y la protección del derecho de huelga en el ámbito internacional, con especial énfasis en el debate suscitado en la OIT respecto a su reconocimiento —implícito— en el Convenio 87. Se examinan las posturas divergentes entre el Grupo de los Empleadores y el de los Trabajadores, la interpretación de los órganos de control de la OIT, y el desarrollo jurisprudencial dentro del Sistema Interamericano de Derechos Humanos, con especial atención a la Opinión Consultiva OC-27/21 de la Corte Interamericana de Derechos Humanos. El texto destaca la importancia del reconocimiento implícito y explícito del derecho de huelga, su carácter como derecho humano fundamental, y la interdependencia entre la libertad sindical y el derecho de huelga como desafío actual para su protección efectiva en la normativa internacional.

    This article analyses the recognition and protection of the right to strike at the international level, with special emphasis on the debate within the ILO regarding its —implicit— recognition in Convention 87. It examines the divergent positions of the Employers’ and Workers’ groups, the interpretation of the ILO supervisory bodies, and the development of jurisprudence within the Inter-American Human Rights System, with special attention to Advisory Opinion OC-27/21 of the Inter-American Court of Human Rights. This text highlights the importance of the implicit and explicit recognition of the right to strike, its character as a fundamental human right, and the interdependence between freedom of association and the right to strike as a current challenge for its effective protection in international law.
