  • The author questions the role that collective bargaining can play in investee companies in relation to smart working, as an institution related to the management of the employment relationship, where the concern is not economic, but rather organizational and aimed at serving the needs of effectiveness and efficiency, which are the basis of the option for the private regime present in Legislative Decree No.175/2016. The comparison between the disciplines of the public and private sectors will serve to illustrate possible regulatory perspectives.
