Justicia en deuda: desafíos del acceso legal para mujeres víctimas de violencia familiar en México

    El estudio analiza las barreras sociales, culturales e institucionales que limitan el acceso efectivo a la justicia de mujeres en situación de violencia familiar en México. La investigación se centra en identificar los factores que obstaculizan el ejercicio pleno de sus derechos, pese a la existencia de marcos normativos nacionales e internacionales. Se planteó la hipótesis de que estas barreras se derivan de la falta de perspectiva de género en la atención jurídica, la revictimización institucional y la deficiente aplicación de la ley. Los resultados evidenciaron que, aunque el marco legal es sólido, su implementación es insuficiente, persistiendo prácticas institucionales discriminatorias, retrasos en los procesos y estigmas culturales que dificultan el acceso a la justicia. La investigación concluye que es necesario fortalecer políticas públicas y protocolos institucionales con perspectiva de género, para garantizar un acceso real, efectivo y sensible a la justicia de las mujeres víctimas de violencia familiar.

    The study analyzes the social, cultural, and institutional barriers that limit the effective access to justice for women in situations of domestic violence in Mexico. The research focuses on identifying the factors that hinder the full exercise of their rights, despite the existence of national and international legal frameworks. The hypothesis proposed that these barriers stem from the lack of a gender perspective in legal services, institutional revictimization, and poor enforcement of the law. The findings revealed that, although the legal framework is solid, its implementation is insufficient. Discriminatory institutional practices persist, along with delays in legal processes and cultural stigmas that impede access to justice. The study concludes that it is necessary to strengthen public policies and institutional protocols with a gender perspective, in order to ensure real, effective, and gender-sensitive access to justice for women victims of domestic violence.
