La práctica española ha mantenido, durante años, una posición ambigua en torno a la eficacia de los contratos de gestación por sustitución, con caminos divergentes entre la jurisprudencia del TS y la vertiente registral. La nueva Instrucción DGSJFP pretende alinearse con el TS, pero se siguen manteniendo situaciones inciertas derivadas del traslado de los menores para la determinación de la filiación, el abuso en la utilización de la adopción y la necesidad de dar eficacia a filiaciones constituidas en otros Estados con los que exista vinculación real por los comitentes.

For years, Spanish practice has maintained an ambiguous position regarding the effectiveness of surrogacy contracts, with diverging ways between the case law of the Supreme Court and the Civl Registry. The new DGSJFP Instruction seeks to align itself with the Supreme Court, but uncertain situations remain arising from the transfer of minors for the determination of parenthood, the abuse of adoption, and the need to validate parenthood established in other States with which the intending parents have a real relationship.
