La puesta en marcha de la ley española de regulación de la eutanasia

    Este trabajo analiza la eutanasia tras su regulación en España por la Ley Orgánica 3/2021, de 24 de marzo, de Regulación de la Eutanasia (LORE). Esta ley ha supuesto un radical cambio en el régimen jurídico general de la materia, especialmente en el sanitario habida cuenta que una importante parte de su contenido regula el derecho a la eutanasia desde un punto de vista médico y asistencial. Esta ley regula el marco legal de la ayuda médica a morir al establecer los requisitos, el procedimiento y las garantías del procedimiento eutanásico. La LORE también tiene connotaciones penales puesto que para su puesta en funcionamiento ha tenido que modificar el art. 143 del Código Penal español. La puesta en funcionamiento de este texto legal, como ya sucedió con la legalización del aborto, va a estar plagado de obstáculos habida cuenta que este tipo de leyes tiene fuertes connotaciones morales y religiosas.

    This work analyzes euthanasia after its regulation in Spain by Organic Law 3/2021, of March 24, on the Regulation of Euthanasia. This law has meant a radical change in the general legal regime of the matter, especially in the health sector, given that an important part of its content regulates the right to euthanasia from a medical and care point of view.

    This law regulates the legal framework of medical aid to dying by establishing the requirements, the procedure and the guarantees of the euthanasia procedure. The LORE also has criminal consequences since for its implementation it has had to modify art. 143 of the Spanish Penal Code. The implementation of this legal text, as already happened with the legalization of abortion, will found numerous obstacles, given that this type of law has strong moral and religious connotations.
