Régimen de Previsión Social Docente de Jurisdicción Nacional. Concepto e historia: de Julio A. Roca a Néstor Kirchner

    En el artículo se propone un análisis del sistema previsional de los docentes de jurisdicción nacional (no universitario) en un amplio recorte histórico que transita desde finales del siglo XIX (los orígenes) hasta principios del XXI (última reforma). Incluyendo, sintética y complementariamente, el régimen jubilatorio actual de los docentes de aquellas provincias que durante los años noventa han transferido sus cajas de previsión social a la esfera nacional (ANSeS). Un estudio diacrónico y comparativo de diferentes normativas jurídicas (leyes-decretos) que a través del tiempo institucionalizaron los diferenciales regímenes del sector. El problema central queda enmarcado históricamente en una breve reseña de la evolución en el tiempo del sistema de previsión social nacional general. A la vez, es contenido en una aproximación histórica y conceptual de los denominados “regímenes especiales” de previsión, considerando ciertos ejes centrales vinculados a la labor docente que la incluyen en esa modalidad.Finalmente, se arriesga una categorización susceptible de abstraer los diferentes regímenes jubilatorios docentes en función de las particularidades asumidas en los diferentes momentos históricos. Lejos de proyectarse un cierre del problema, nuevos interrogantes delimitan una apertura a futuras investigaciones.

    The aim of this paper is to examine the temporary system of the of the national teachers (not professors of universities) in the historical context of upward adjustment between the late 19th century (the origins) to the early 21st century (the last reform). The article includes, as a complement, the current retirement system of the teachers from the provinces which, at the 90s, the retirement accounts were transferred to the federal jurisdiction (ANSeS). A diachronic and comparative study of the different legal regulations is made (laws - decrees) which through time made the different regimes of this area official. The main issue is delimited on a brief review of the evolution of the social welfare system. At the same time, is a historical and conceptual approximation to the denominated social welfare "special regimes”, taking into account certain central axis connected to the teachers’ labour in which this modality is included.

    Finally, this article leads to a sensitive and abstract categorization of the different teachers’ retirement regime in relation to the assumed distinctive features on different historical moments which include this modality. Far from projecting a closure to the problem, new questionings delimit an opening to future investigations.
