  Este estudio analiza el testimonio anticipado de personas procesadas con discapacidad psicosocial y su credibilidad en el proceso penal ecuatoriano. Para ello, se emplearon métodos exegético-jurídico y hermenéutico, enfocándose en un análisis detallado de normativas como la Constitución, el Código Orgánico Integral Penal (COIP), y la Ley Orgánica de Discapacidades, así como sentencias judiciales relevantes. Esto permitió identificar vacíos legales y evaluar la coherencia de las disposiciones con principios constitucionales y tratados internacionales. Paralelamente, mediante el método empírico, se realizaron entrevistas semiestructuradas a operadores jurídicos y expertos, recolectando información sobre la aplicación práctica de estas normativas y las barreras enfrentadas por personas con discapacidad psicosocial en los procesos judiciales. Los hallazgos destacan la necesidad de ajustes normativos, formación de operadores de justicia y mayor protección de los derechos de este grupo.

  This study analyzes the advance testimony of people with psychosocial disabilities and their credibility in the Ecuadorian criminal process. To do so, exegetic-legal and hermeneutic methods were used, focusing on a detailed analysis of regulations such as the Constitution, the Comprehensive Organic Criminal Code (COIP), and the Organic Law on Disabilities, as well as relevant court rulings. This allowed us to identify legal gaps and evaluate the coherence of the provisions with constitutional principles and international treaties. At the same time, using the empirical method, semi-structured interviews were conducted with legal operators and experts, collecting information on the practical application of these regulations and the barriers faced by people with psychosocial disabilities in judicial processes. The findings highlight the need for regulatory adjustments, training of justice operators and greater protection of the rights of this group.
