    Las nuevas dinámicas familiares que acontecen en México nos obliga a estudiar los aspectos de la maternidad, máxime cuando observamos los matrimonios integrados por personas del mismo sexo en perspectiva de derechos humanos, para lo cual se cuenta con la maternidad subrogada como una posibilidad que les permite acceder y concretar un proyecto de vida que contemple hijos, de igual forma esta figura jurídica les da las mismas posibilidades de maternidad a las personas con problemas de fertilidad, y solteros que buscan hacer realidad  los derechos reproductivos, lo cual a la luz de la constitución y el principio de igualdad y no discriminación se cuenta con la posibilidad de realizar de la paternidad o la maternidad. El derecho tiene la obligación de generar buenas condiciones para generar estas realizaciones familiares de forma legal, y, por tanto, que impida la clandestinidad y el mercado negro en cuestiones de sexualidad y reproducción. En suma, la maternidad subrogada permite concretar la maternidad de forma completamente responsable, dado que cuenta con todo el respaldo del Estado de Derecho.

    The new family dynamics that occur in Mexico force us to study the aspects of motherhood, especially when we observe marriages made up of people of the same sex from a human rights perspective, for which surrogacy is available as a possibility that allows them access and realize a life project that includes children, in the same way this legal figure gives the same possibilities of motherhood to people with fertility problems, and singles who seek to make reproductive rights a reality, which in light of the constitution and the principle of equality and non-discrimination is available with the possibility of paternity or maternity. The law has the obligation to generate good conditions to generate these family achievements legally, and, therefore, to prevent clandestinity and the black market in matters of sexuality and reproduction. In short, surrogacy allows motherhood to be carried out in a completely responsible way, given that it has the full support of the Rule of Law.
