La Propuesta Ómnibus UE y la afectación de la diligencia debida: una primera aproximación

    La Unión Europea ha destacado en los últimos años por ser pionera en introducir una normativa comunitaria dirigida a hacer de Europa el primer con-tinente climáticamente neutro. Así, se han dictado toda una serie de normas con esa finalidad, y una de ellas tiene que ver con la exigencia de responsabilidades empresa-riales a través de la diligencia debida en materia de medio ambiente, sostenibilidad y gobernanza. Sin embargo, muy recientemente, se están haciendo propuestas que parecen ir en una dirección distinta y, en algunos supuestos, contraria, a la mencio-nada, o, al menos, a restar eficacia a lo legislado con anterioridad en materia de cam-bio climático y sostenibilidad.La razón de ello no se ha concretado aún, ni tampoco puede concretarse el al-cance que esto puede tener en el futuro, si bien es llamativo que la Comisión Europea quiera imponer ahora obligaciones de un alcance menor que las establecidas en las Directivas paradigmáticas en la materia y ralentizar el ritmo que había impuesto para llegar a conseguir el objetivo propuesto en los tiempos marcados.

    In recent years, the European Union has stood out to be a pioneer in introducing EU regulations aimed at making Europe the first climate-neutral continent. Thus, a whole series of regulations have been issued for this purpose, and one of them concerns the requirement for corporate responsibility through due diligence in matters of the environment, sustainability, and governance. However, very recently, proposals are being made that appear to go in a different direction, and in some cases, contrary to the aforementioned, or at least to diminish the effectiveness of previous legislation on climate change and sustainability.The reason for this has not yet been specified, nor can the scope that this may have in the future be specified, although it is striking that the European Commission now wants to impose obligations of a lesser scope than those established in the paradigmatic Directives on the matter and slow down the pace that had been set in order to achieve the proposed objective in the established time
