    The study aims to understand the legitimacy of the expansive role of the Judiciary and how it impacts on the representation of the population. Through bibliographic research and the analysis of judicial decisions, the study sought to analyze the limits imposed on the expansion of jurisdictional activity. Thus, it was possible to identify that, in the face of legislative omissions, the judicialization of demands is a natural and positive consequence for the realization of fundamental rights. However, it is necessary to respect the limits of legislative competence, avoiding arbitrariness and preserving the role of the Legislature as the representative of the population.

    O estudo tem por objetivo compreender a legitimidade da atuação expansiva do Poder Judiciário, e como essa atuação impacta a representatividade da população. A partir da pesquisa bibliográfica e da análise de decisões judiciais, buscou-se examinar os limites impostos à expansão da atividade jurisdicional. Assim, foi possível identificar que, diante de omissões legislativas, a judicialização de demandas é uma consequência natural e positiva para efetivação dos direitos fundamentais. No entanto, faz-se necessário respeitar os limites da competência legislativa, evitando a arbitrariedade e preservando o papel do Legislativo como representante da população.
