    El objetivo de este artículo es dilucidar cómo el fundamento dual de la legítima defensa se expresa mediante los elementos objetivo y subjetivo de las causas de justificación mediante un estudio comparado entre los numerales 4, 5 y 6 del artículo 10 del Código Penal Chileno y el artículo 20.3 del Código Penal Peruano. Las conclusiones refirieron que el elemento subjetivo es expresión, en mayor medida, de la protección jurídica individual, mientras que el elemento objetivo, mayormente, es expresión de la protección jurídico social. El presente estudio procura aportar en la comprensión de la legítima defensa, a nivel de derecho comparado entre Perú y Chile, desde los fundamentos, que la hacen posible, hacia los elementos que la componen.

    The aim of this article is to elucidate how the dual foundation of self-defense is expressed through the objective and subjective elements of justifying circumstances through a comparative study between sections 4, 5, and 6 of article 10 of the Chilean Criminal Code and article 20.3 of the Peruvian Criminal Code. The article concludes that the subjective element is an expression, to a great extent, of individual legal protection, while the objective element, mostly, is an expression of socio-legal protection. This research seeks to contribute to the understanding of self-defense, at the level of comparative law between Peru and Chile, from the foundations that make it possible to the elements that constitute it.
