Politización de la justicia: ¿un problema? A propósito del Tribunal Constitucional [1.2817]

    En la labor jurisdiccional también se han ‘‘complejizado‘‘ los paradigmas clásicos con los cuales se construye el Estado. Debido a nuestras originarias ideas se repite incansablemente que el juez es la ‘‘boca de la ley‘‘, lo que deposita la soberanía de su decisión en las reglas previas y expresamente erigidas por los órganos legisladores, y oculta, mediante una narración interna del Derecho, una cierta libertad otorgada a los juzgadores. ¿Es esto un problema? Responderemos negativamente. El problema radica en la concepción clásica de la estructura estatal que comprende que es posible aplicar normas jurídicas sin ningún atisbo de incidencia política o ideológica. En virtud de esta realidad, que permea hasta las más recientes resoluciones de la justicia constitucional, es necesario un análisis.

    Regarding tribunals, the classic State paradigms have become more complex. We tirelessly repeat that the judges are the “mouth of the law”, and argue that the sovereignty of their rulings are derived from rules previously and expressly enacted by the legislator. This hides, through an internal narration of the Law, a certain freedom granted to the judges. Is this a problem? We contend it is not. The problem lies in the classical conception of the State structure that understands that applying legal norms does not involve politics or ideology. We have to analyze this belief, as it permeates even the most recent rulings of constitutional justice.
