El abuso de la proposición de ley y de la presentación de enmiendas sin conexión material: dos manifestaciones de la distorsión en la función legislativa en tiempos de fragmentación parlamentaria

    La función legislativa se ve afectada por varias distorsiones que han alterado sustancialmente, en el seno de las cámaras, el proceso de formación de la voluntad de las Cortes. Son consecuencia del empleo de medios que permiten sortear garantías, límites y controles que, de otro modo, vendrían impuestos. Su uso frecuente compensa la debilitada capacidad propia de actuación del Gobierno, la cual es el resultado de su posición minoritaria y del carácter contingente de los respaldos que merecen sus iniciativas en un escenario de acusada fragmentación parlamentaria. Se manifiestan en la proposición de ley como medio a través del cual ejercer, de manera indirecta, esto es, por medio de actores interpuestos, la iniciativa legislativa que el Ejecutivo desea promover. Y en la presentación de enmiendas, sin conexión material con el texto principal al que se unen, que es objeto de tramitación, para introducir, así, regulaciones heterogéneas, de forma sobrevenida, aprovechando aquella.

    The legislative function is affected by several distortions that have substantially altered, within the Chambers, the process of forming the will of Parliament. These are the result of the use of instruments that allow the circumvention of guarantees, limits and controls that would otherwise be imposed. Their frequent use compen-sates for the weakened capacity of the Government to act, which is a consequence of its minority position and the contingent nature of the support that its initiatives deserve in a scenario of marked parliamentary fragmentation. They are manifested in the bill as a means through which to exercise, indirectly, that is, through inter-posed actors, the legislative initiative that the Executive wishes to promote. And in the presentation of amendments without material connection with the main text to which they are attached, which is the subject of processing, to introduce, thus, heter-ogeneous regulations, in a supervening manner, taking advantage of the former. Through both proceedings, the guarantees that are inherent to the Rule of Law are devalued.
