Investments in venture capital entities may be exempt from Wealth Tax subject to compliance with the relevant legal requirements.

To this effect, the General Directorate for Taxation has repeatedly stated that the securities in which these entities invest in compliance with their mandatory investment coefficient are held in order to comply with a legal obligation and, therefore, would be considered to be securities that are necessary for their activity.

Notwithstanding this, this type of investment raises controversial questions regarding compliance with the rest of the requirements for the tax exemption, which will have to be considered on a case-by-case basis.
