    El cambio climático es actualmente objeto de tres procedimientos consultivos paralelos. En diciembre de 2022, la Comisión de Pequeños Estados Insulares sobre Cambio Climático y Derecho Internacional presentó ante el Tribunal Internacional del Derecho del Mar una solicitud de opinión consultiva sobre las obligaciones de los Estados en materia de protección del medio ambiente marino de las consecuencias del cambio climático. En enero de 2023, las Repúblicas de Colombia y Chile iniciaron conjuntamente un segundo procedimiento consultivo ante la Corte Interamericana de Derechos Humanos sobre obligaciones de los Estados en materia de derechos humanos frente a la emergencia climática. Por último, tras un largo proceso de negociación liderado por la República de Vanuatu e inspirada por asociaciones de la juventud, la Asamblea General de Naciones Unidas adoptó de la Resolución 77/276 del 29 de marzo de 2023, que remite a la Corte Internacional de Justicia una tercera solicitud de opinión consultiva sobre obligaciones de los Estados en materia de cambio climático y consecuencias jurídicas derivadas de dichas obligaciones. El presente curso aborda los antecedentes y contenido de estos tres procedimientos consultivos, considerándolos como componentes de una estrategia judicial común, cuyo objetivo es potenciar la acción climática internacional y establecer las bases jurídicas para un futuro sistema de reparación.

    Climate change is currently addressed by three parallel advisory proceedings. In December 2022, the Commission of Small Island States on Climate Change and International Law submitted to the International Tribunal for the Law of the Sea a request for advisory opinion on the obligations of States in respect of the protection of the marine environment from climate change impacts. In January 2023, the Republics of Colombia and Chile jointly initiated a second advisory proceeding before the Inter-American Court of Human Rights on obligations of States under international human rights law in the face of the climate emergency. Finally, after a long negotiation process led by the Republic of Vanuatu and inspired by youth associations, the UN General Assembly adopted Resolution 77/276 of 29 March 2023, referring to the International Court of Justice a third request for advisory opinion on obligations of States in respect on climate change and legal consequences arising from such obligations. The present Course addresses the background and content of these three advisory proceedings, considering them as components of a common judicial strategy aiming to enhance international climate action and establish the legal basis for a future system of redress.
