  Nuestro ordenamiento jurídico ha ido dando pasos significativos hacia la muerte digna de toda persona. Pese a ello se siguen produciendo desajustes importantes en la aplicación normativa, que determinan una vulneración en la práctica de los derechos legalmente reconocidos. Este artículo pretende ahondar sobre la muerte de las personas mayores desde un enfoque de derechos, a fin de valorar en qué medida este grupo poblacional es consciente de sus derechos; si reivindica su ejercicio y las condiciones para hacerlo o no; si se les reconoce o no como sujeto de derechos ante la muerte; y evidenciar con ejemplos recientes las consecuencias que comporta la desprotección o la vulneración de dichos derechos. Se trata de ver si existe una especial consideración en las normas a las personas mayores cuando de la muerte hablamos, reflexionar sobre si cabe justificar un tratamiento diferenciado que especifique sus derechos o por el contrario no, y a tal propósito, analizar los instrumentos normativos que sí lo realizan como, parcialmente, la Convención interamericana de derechos de las personas mayores y su alcance.

  Our legal system has taken significant steps towards the dignified death of every person. Despite this, there are still significant imbalances in the application of the law, leading to a violation of legally recognised rights in practice. This article aims to examine the death of the elderly from a rights-based approach, in order to assess the extent to which this population group is aware of their rights; whether or not they claim to exercise them and the conditions for doing so; whether or not they are recognised as subjects of rights in the face of death; and to demonstrate, with recent examples, the consequences of the lack of protection or the violation of these rights. The aim is to see if there is special consideration in the norms for the elderly when it comes to death, to reflect on whether a differentiated treatment that specifies their rights can be justified or not, and for this purpose, to analyse the normative instruments that do, such as, partially, the Inter-American Convention on the Rights of the Elderly and its scope.
