    En la presente investigación se analizarán los avances y retrocesos en torno al daño transgeneracional como un daño resarcible en el esquema de reparaciones de la Corte Penal Internacional. Para ello, se tomará como punto de partida para el análisis el estudio del proceso del Fiscal de la Corte Penal Internacional contra Bosco Ntaganda. De esta forma, se explorarán sus antecedentes jurisprudenciales, las repercusiones del caso, la relación entre los pronunciamientos de la Corte Interamericana de Derechos Humanos y la recepción interpretativa de los mismos por la Corte Penal Internacional en la etapa de reparaciones del caso contra Ntaganda. Como resultado del análisis, intentaremos dar respuesta a la pregunta de si el caso Ntaganda resultaría un leading case en materia de reparación de daño transgeneracional.

    This research will analyze the advances and setbacks around transgenerational harm as a compensable harm in the reparations scheme of the International Criminal Court. To this end, the study of the trial of the Prosecutor of the International Criminal Court vs. Bosco Ntaganda will be taken as a starting point for the analysis. In this way, its jurisprudential background, the repercussions of the case, the relationship between the pronouncements of the Inter-American Court of Human Rights and the interpretative reception of them by the International Criminal Court in the reparations stage of the case against Bosco Ntaganda will be explored. As a result of the analysis, we will try to answer the question of whether the Ntaganda case would be a leading case in terms of reparation for transgenerational damage.
