On the occasion of a ruling by the Supreme Court, which invalidated the decision of the Superinten-dence of Electricity and Fuels, consisting of not authorizing the change of an end user to the free pricing regime, this work analyzes the limits that the highest court has imposed to the interpretative power of said public body, specifically, in relation to respect for the principle of legality. In this sense, it concludes that the analyzed ruling contemplates objective standards, which must guide the foun-dation of administrative acts in electrical matters, in order to prevent the Administration, under the pretext of its declaratory power, from being able to demand that older or different citizens requirements than those contemplated in the law.
