    The regulation of the carriage of livestock –namely, for the purpose of the present article, the one made by sea– places several problems which legal experts have not considered as they should be, as it represents an area with manifest dogmatic interest. The present article analyses the corresponding legal framework and its singularities, whilst considering the latest proposals for review and problematising around the validity of the exclusion clauses of liability in favour of the carrier.

    Tema sobre o qual a atenção de juristas não se tem concentrado, a regulação do transporte de animais vivos –no que aqui nos interessa, por mar– representa uma área com manifesto interesse dogmático. O presente artigo visa dar a conhecer o correspondente regime e as suas singularidades, acompanhando as últimas propostas de revisão e problematizando em torno da licitude das cláusulas de exoneração neste especial tipo de transporte.
