  • The Author underlines the difficulties of enacting mobbing model fact situation in Italian legal order. These difficulties spring from many different sources. In details, a possible combination between article 2087 and article 1218 of the Civil Code is taken in account, under the view of the protection of employee's moral personality. Moreover, the essay examines the employer's liability. In the final part, the Author highlights how the discussed problems lead to a theoretical alternation between non pecuniary and existential damage.
