La cadena agroalimentaria como contenido del derecho agrario contemporáneo

    Atualmente, o direito agrário tem um novo desafio: permitir a realização da segurança alimentar, cada vez mais ligada às quantidades de produção de alimentos, mas também, as suas qualidades. O trabalho levanta quais são as orientações contemporâneas do direito agrário que prioriza dados econômicos antes das demandas de Segurança Alimentar. Para tanto, analisa-se o fenômeno agroalimentar e os mercados, bem como a empresa e a cadeia agroalimentar, à luz do direito da Comunidade Europeia. Conclui-se afirmando que o direito agrário não pode mais ser um direito unido apenas para fornecer soluções aos problemas da terra e do produtor ou empresário agrário. Será necessário se concentrar no ciclo biológico, complementado pelo fenômeno dos mercados, nos impactos da atividade agrícola no meio ambiente e no desenvolvimento humano: elos que levam à formulação legal da cadeia agroalimentar. É preciso saber lidar com os impactos da internacionalização, da integração, regionalização, intersetorialidade, interdisciplinaridade, solidariedade, concertação. Como metas a serem atingidas, emergem a qualidade agroalimentar e agroambiental, à luz dos direitos humanos fundamentais, a proteção do meio ambiente, a busca do desenvolvimento sustentável e a promoção da qualidade de vida dos consumidores. Eis aqui uma extensão possível dos propósitos do direito agrário, que traz consigo as novas orientações da disciplina.

    Currently agrarian law has a new challenge: enable the achievement of Food Security, a subject tied not only to the quantity of food production, but to the quality of it. The work asks if the modern orientations of Agrarian law prefer the economic data, before the demands of Food Security? To this end, the agri-food phenomenon and markets are analyzed, as well as the company and the agri-food chain in light of European Community law. It is concluded by affirming that the new Agrarian law can no longer be the Law attached only to provide solutions to the problems of the land and of the producer or agrarian entrepreneur. It will be necessary to focus on the biological cycle, complemented by the phenomenon of markets; the impacts of agricultural activity on the environment and on human development; the legal formulation of the agri-food chain. We are facing a Law that receives the impacts of internationalization, but also of integration, regionalization, intersectorality, interdisciplinarity, solidarity, concertation, showing itself to be multifunctional. As goals to be reached, agri-food and agro-environmental quality emerge, in the light of fundamental human rights to: the environment, sustainable development, the quality of life of consumers. Continuously operates an extension of agrarian law purposes, which brings with it the new orientations of the discipline.
