La aplicación de la doctrina del «levantamiento del velo» en el ámbito laboral: la averiguación de la existencia de relación laboral

    El presente estudio reflexiona cómo se debe aplicar la denominada doctrina del «levantamiento del velo» para la averiguación de la existencia de una relación laboral. Para ello, se elabora un concepto de «levantamiento del velo» distinto en el ámbito laboral respecto del identificado en el ámbito mercantil, para, en atención a su definición, delimitar los contornos de aplicación de la doctrina para concluir sobre la existencia o no de una relación laboral, partiendo de la normativa reguladora de la cuestión, en particular, los conceptos de empresa y/o empresario/a laboral —art. 1.2 ET— y las notas de la laboralidad —art. 1.1 ET—. Además, se aborda una aproximación doctrinal respecto de la equiparación de la presunción de laboralidad —arts. 8.1 y 2 tercer párrafo LRJS— y la doctrina del «levantamiento del velo» en el ámbito laboral. Junto a ello, se sistematiza la jurisprudencia más reciente relacionada con el concepto de empresa y/o empresario/a laboral —primera de las exigencias de la doctrina del «levantamiento del velo» para la averiguación de la existencia de una relación laboral—, y del cumplimento de las notas de laboralidad, especialmente la dependencia, la ajenidad y la retribución, ya que sólo cuándo éstas se cumplan en relación con quien tenga la condición de empresa y/o empresario/a laboral, podrá entenderse «levantado el velo», constatada la existencia de una relación laboral, y se proyectará la batería de derechos y obligaciones derivados de la misma. Por último, se aborda en perspectiva doctrinal, las consecuencias de la supresión del art. 148 d) LRJS y su correspondiente reforma del procedimiento de oficio, con la atribución de competencias para aplicar la doctrina del «levantamiento del velo» laboral al orden contencioso-administrativo.

    This study reflects on how the so-called «lifting of the veil» doctrine should be applied to ascertain the existence of an employment relationship. To this end, a different concept of «lifting of the veil» is developed in the labor sphere with respect to that identified in the coporate sphere, in order to, based on its definition, delimit the contours of application of the doctrine to conclude on the existence or not of an employment relationship, starting from the regulations governing the issue, in particular, the concepts of company and/or employer —article 1.2 Labor Statute— and the notes of an employment relationship —art. 1.1 Labor Statute—. In addition, a doctrinal approach is addressed with respect to the equivalence of the presumption of employment —arts. 8.1 and 2 third paragraph LRJS— and the doctrine of the «lifting of the veil» in the labor field. Along with this, the most recent jurisprudence related to the concept of company and/or labor employer is systematized —first of the requirements of the «lifting of the veil» doctrine for the ascertainment of the existence of an employment relationship—, and of the fulfillment of the notes of employment, especially dependence, only when these are fulfilled in relation to the person who has the status of company and/or labor employer, can the veil be understood as «lifted», the existence of an employment relationship be ascertained, and the battery of rights and obligations deriving from the same will be projected. Finally, from a doctrinal perspective, the consequences of the suppression of art. 148 d) LRJS and its corresponding reform of the ex officio procedure are addressed, with the attribution of powers to apply the doctrine of the «lifting of the labor veil» to the contentious-administrative order.
