Desafíos actuales en la protección jurisdiccional para las personas en situación de vulnerabilidad

    ¿Cómo se alcanza la justicia?, ¿Cuál es su contenido?, ¿En qué se traduce su obtención? Estas preguntas son solo poco de lo mucho que se puede cuestionar sobre uno de los derechos más importantes que se nos debe garantizar a todos por el solo hecho de ser personas, pero, ¿cómo funciona realmente el acceso a la justicia en nuestro país? y, lo más importante, ¿se garantiza el acceso a la justicia a los grupos históricamente discriminados y en situaciones de vulnerabilidad?. Cuestionarnos lo anterior es el objetivo de nuestro artículo de investigación, consideramos que nuestro sistema jurídico recientemente ha avanzado en su búsqueda por el respeto y la protección más amplia a los derechos de las personas, pero, ¿en qué nivel de reconocimiento nos encontramos? y, ¿qué es lo que resta por hacer?, por ello, en este trabajo desarrollamos una reflexión que relaciona este derecho con los grupos vulnerables.

    How is justice done? What´s its content? What do we understand for justice? This are just few of the many questions that we can ask ourselves about how we can guarantee justice to all of us just for the simple fact of being humans. How does justice work in our country? And the most important question is, is access to justice guaranteed to the most historically violated and discriminated groups?. Those questions are the main purpose of this article; we consider that our judicial and legal system has taken a step forward on the implementation of the respect and protection of human rights to the vulnerable groups and the population in general, but those efforts are not enough yet and there´s so much more work to do, so that´s why in the present article we have related this right with the vulnerable population.
