Políticas renovadas en pro de los derechos humanos de las personas inmigrantes: ¿nuevas oportunidades? Un repaso al reciente desarrollo reglamentario de la Ley de Extranjería (Real Decreto 1155/2024, de 19 de noviembre)

    Con entrada en vigor el 20 de mayo de 2025, el Real Decreto 1155/2024, de 19 de noviembre, estructurado en un artículo único que aprueba el nuevo Reglamento de la Ley Orgánica 4/2000, de 11 de enero, sobre derechos y libertades de los extranjeros en España y su integración social, nace con la pretensión —no nueva pero sí renovada— de simplificar y agilizar los procedimientos, reducir los tiempos y mejorar la concreción jurídica respecto a las figuras y situaciones administrativas de las personas inmigrantes en nuestro país; todo ello, en aras a conseguir una mayor claridad, seguridad jurídica y protección de los derechos de las mismas, en consonancia con las directrices o líneas marcadas desde la Unión Europea. En la nueva normativa, se abrevian los procesos, se eliminan duplicidades y se da mayores garantías y rigor jurídico, previendo regularizar a un número importante de personas inmigrantes durante los próximos años. Este trabajo se erige como primer paso para el estudio y análisis de estas importantes modificaciones en nuestro ordenamiento jurídico que, con sus luces y sombras, introducen cambios que afectan de manera generalizada al estatus de las personas extracomunitarias en España.

    Coming into effect on May 20, 2025, Royal Decree 1155/2024, of November 19, structured in a single article that approves the new Regulation of Organic Law 4/2000, of January 11, on the rights and freedoms of foreigners in Spain and their social integration, is introduced with the aim-neither new but now renewed-of simplifying and streamlining procedures, reducing processing times, and improving legal clarity with respect to the administrative statuses and situations of immigrants in our country. All of this is intended to achieve greater clarity, legal certainty, and protection of their rights, in line with the directives and guidelines established by the European Union. The new regulation shortens processes, eliminates redundancies, and provides greater guarantees and legal rigor, with the aim of regularizing a significant number of immigrants over the coming years. This work stands as a first step towards studying and analyzing these important modifications to our legal framework which, with their strengths and weaknesses, introduce changes that broadly affect the status of non-EU citizens in Spain.
