The problem this article focuses on is: how does Luis Alberto Warat’s legal proposal dialogue with the theme of neoliberal subjectivity? The objective is to explore the complex relationship between subjectivity, Law and neoliberalism in the aforementioned author's work. The qualitative methodology was used, as well as the document analysis technique, since the connection between subjectivity, Law and neoliberalism was established according to the Waratian theoretical contribution. An analytical and didactic approach to Warat's reflections was pursued, demonstrating both the centrality of the idea of subjectivity throughout his work, as well as how the neoliberalism category was already relevant in his work. As a conclusion, this paper sought to demonstrate the protagonism and actuality of Luis Alberto Warat for contemporary social legal critique. He not only provides a contemporary diagnosis of the problems that Law must face, but he continues to be innovative in placing subjectivity at the center of the legal issue and pointing out paths of resistance. He positioned himself as a staunch critic of the homogeneous and universal neoliberal subjectivity, represented by the self-entrepreneur figure. As an alternative to this system, he proposed to view subjectivity as the result of an in-between and that demands political-social attention and care, which he defined as otherness.

O problema deste artigo é: de que forma a proposta jurídica de Luis Alberto Warat dialoga com o tema da subjetividade neoliberal? O objetivo é explorar a complexa relação entre subjetividade, Direito e neoliberalismo na obra do citado autor. A metodologia utilizada foi a qualitativa, com revisão documental, pois, com base no aporte teórico waratiano, estabeleceu-se a conexão entre subjetividade, Direito e neoliberalismo. Buscou-se adentrar de forma analítica e didática ao pensamento de Warat, demonstrando tanto a centralidade da ideia de subjetividade para o seu pensamento, como o quanto a categoria neoliberalismo já tinha relevância para a sua obra. Como conclusão, procurou-se demonstrar o protagonismo e a atualidade de Luis Alberto Warat para a crítica jurídica social contemporânea. Ele não apenas faz um diagnóstico atual dos problemas que o Direito deve enfrentar, como continua sendo inovador ao situar a subjetividade no centro da questão jurídica e apontar caminhos de resistência. Colocou-se como um crítico ferrenho da subjetividade homogênea e universal neoliberal, representada pelo homem empresário de si. Ofereceu, como contraposição a esse sistema, a compreensão da subjetividade como fruto de um entre-nós, que deve ter atenção e cuidado político-social, o que definiu como alteridade.
