This essay has as its main theme the figure of the nomos in Carl Schmitt, its appearance from the notion of concrete order, its evolution, and its structure. This figure appears discreetly amid a moment of inflection in the thinking of the German jurist, unfolds as ordering of territorial space and, finally, is arranged in a triadic modal structure (take – divide – herding) which expresses the origin and foundation of law. At the end of the essay, a fundamental question – the nexus between nomos and necessity – is espied but left open.

Este ensaio tem como tema principal a figura do nómos em Carl Schmitt, seu aparecimento a partir da noção de ordenamento concreto, sua evolução e sua estrutura. Essa figura surge discretamente em meio a um momento de inflexão no pensamento do jurista alemão, desdobra-se como ordenação do espaço territorial e, por fim, se conforma numa estrutura modal triádica (tomar – dividir – pastorear) que expressa a origem e o fundamento do direito. Ao final do ensaio, uma questão de fundo – a relação entre nómos e necessidade – é entrevista mas deixada em aberto.
