Significado psicológico de justicia restaurativa y justicia terapéutica en una muestra de jóvenes colombianos

    La justicia restaurativa y la justicia terapéutica buscan ofrecer una alternativa al acercamiento punitivista de la justicia retributiva, que no resuelve las causas de fondo de la conducta delictiva y las consecuencias que esta tiene sobre las víctimas y las comunidades. En Colombia, los principios de la justicia restaurativa y la justicia terapéutica se han aplicado principalmente en adolescentes, a través del Sistema de Responsabilidad Penal Adolescente y en programas encaminados a intervenir problemas de consumo de sustancias psicoactivas en esta población. El objetivo general del estudio exploratorio fue describir el significado de justicia restaurativa y justicia terapéutica en jóvenes colombianos para construir una línea de base en cuanto al significado de estos términos para contrastar con los significados de otros grupos de interés y, así, promover prácticas basadas en la evidencia que permitan intervenir en la problemática de la criminalidad de una manera más eficaz. Participaron 107 jóvenes, hombres y mujeres, con edades comprendidas entre los 16 y los 26 años; se utilizó la técnica de redes semánticas naturales modificadas. Se encontró que las redes de los dos conceptos difieren de la definición sintáctica y de las posiciones teóricas, lo cual sugiere que el significado que los jóvenes utilizan y recuerdan más en su vida cotidiana es el pragmático, es decir, aquel relacionado con las situaciones y conductas.

    Restorative justice and therapeutic jurisprudence seek to offer an alternative to the punitive approach to retributive justice that does not solve the root causes of criminal behavior and the consequences that it has on victims and communities. In Colombia, the principles of restorative justice and therapeutic jurisprudence have been applied mainly to adolescents, through the Adolescent Criminal Responsibility System and in programs aimed at intervening problems of psychoactive substance use in this population. The general objective of the exploratory study was to describe the meaning of restorative justice and therapeutic jurisprudence in young Colombians to build a baseline regarding the meaning of these terms to contrast with the meanings of other groups of interest and, thus, promote evidence-based practices that allow intervention in the problem of criminality in a more effective way. The participants were 107 young men and women, aged between 16 and 26 years, and the Modified Natural Semantic Networks technique was used. It was found that the networks of the two concepts differ from the syntactic definition and the theoretical positions, which suggests that the meaning that young people use and remember the most in their daily life is pragmatic, that is, the one related to situations and behaviors.
