Tests to detect possible alcoholic intoxication in exhaled air, in particular precision breathalyser tests, must respect the maximum error margins permitted. The controversy about the application of the maximum error permitted in the objective alcohol rate —over 0,60 mg/L alcohol in exhaled air— of the crime provided in the last clause of article 379.2 of the Penal Code, only appear in the 0,65 mg/L alcohol rate in exhaled air. In this case, the application in the pertinent mathematic operation, whether two or three decimals, is not a petty matter, since it determines whether the fact fits in the mentioned article. Recently, the question has been solved by the Supreme Court.
