  En este comentario se analiza la STS de 19 de septiembre de 2024, en la que por primera vez el Alto Tribunal se pronuncia sobre quién debe asumir el coste de la cuota empresarial a la seguridad social en las ayudas “Margarita Salas” y “María Zambrano” y, en particular, si las universidades públicas contratantes deben asumir dicho coste, sin detraerlo de la cuantía de las ayudas de las que traen causa los contratos formalizados con el personal investigador o si, por el contrario, pueden detraer de la cuantía de dichas ayudas el importe correspondiente al pago de la cuota empresarial a la Seguridad Social.

  This commentary analyses the Supreme Court Ruling of 19 September 2024, in which for the first time the Supreme Court ruled on who should bear the cost of the employer’s social security contribution in the Margarita Salas and María Zambrano fellowships. In particular, we will discuss whether the contracting public universities should bear this cost, without deducting it from the amount of the fellowships from which the contracts with the research staff originate, or whether, on the contrary, they can deduct the sum corresponding to the payment of the employer’s social security contribution from the sum of these fellowships.
