    El fideicomiso es una figura jurídica establecida en las leyes mexicanas. Sirve para crear asociaciones de negocios, brindar seguridad financiera y como escudo fiscal. Se exponen los elementos que lo conforman a fin de facilitar su conocimiento a empresarios del ramo inmobiliario, analizando sus antecedentes, especificando su marco legal y fiscal, las ventajas que brinda y los aspectos que hay que cuidar al constituirlo para no caer en ambigüedad y discrepancia fiscal. Se destaca la función de la institución fiduciaria por su importancia. Puede utilizarse como estrategia financiera y fiscal al brindar seguridad y garantía, sin embargo, si no se establece claramente su naturaleza administrativa puede generar costos fiscales no deseados o poca credibilidad financiera.

    The trust is a legal figure established in Mexican law. It serves to create business associations, provide financial security and as a tax shield. The elements that make it up are exposed in order to make it easier for businessmen in the real estate industry, analyzing its background, specifying its legal and fiscal framework, the advantages it provides and the aspects that must be taken care of when constituting it so as not to fall into ambiguity and discrepancy.
