    Esta investigación examina el papel de la Justicia transicional contemporánea en América Latina, con énfasis en dos de sus pilares fundamentales: el esclarecimiento de la verdad y la administración de justicia. Si bien se han detectado avances en el fortalecimiento de los derechos humanos en los regímenes democráticos de la región, persisten desafíos estructurales. Entre ellos, destaca la deficiente persecución de delitos en México y sus consecuencias. En este marco, se analiza el caso de Ayotzinapa (2014) como evidencia de la imperiosa necesidad de reformar el sistema de justicia, comenzando por la investigación delictiva, una etapa fundamental para su eficacia.

    This research examines the role of contemporary transitional justice in Latin America, with an emphasis on two of its fundamental pillars: the clarification of truth and the administration of justice. While progress has been made in strengthening human rights within the region’s democratic regimes, structural challenges persist. Among these, the deficient prosecution of crimes in Mexico and its consequences stand out. Within this framework, the case of Ayotzinapa (2014) is analyzed as evidence of the urgent need to reform the justice system, beginning with criminal investigation, a crucial stage for its effectiveness.
