    El objetivo es analizar la forma de creación de la Agencia Nacional de Aduanas de México desde la facultad reglamentaria del Ejecutivo, así como la facultad de disposición de las fuerzas armadas, a fin de evidenciar su incompatibilidad, rompiendo su estructura al tener una relación administrativa de coordinación, no otro tipo. El método empleado es exegético, sistémico-estructural-funcional. El resultado obtenido es la verificación de nuestra formulación; es decir, la facultad reglamentaria de creación por parte del Ejecutivo Federal con efectos materiales legislativos y formales de mando supremo es incompatible dada su naturaleza jurídica.

    The objective is to analyze the form of creation of the National Customs Agency of Mexico from the regulatory power of the Executive, as well as the power of disposition of the armed forces, in order to demonstrate their incompatibility, breaking its structure by having an administrative relationship of coordination, not any other kind. The method used is exegetical, systemic-structural-functional. The result obtained is the verification of our formulation; That is, the regulatory power of creation by the Federal Executive with material legislative and formal effects of supreme command is incompatible given its legal nature.
