  • Considers the ability for third parties to bring direct claims against the liability insurers of defendants. Examines the procedure for direct actions under traditional Spanish jurisprudence and under the Insurance Contract Act 1980 Art.76. Discusses case law on the application of the direct action to protection and indemnity clubs, including issues relating to the arbitration or jurisdiction clause in the standard rules and the "pay to be paid" rule.
