    Este texto analiza los estándares internacionales que el Estado de Chile debe cumplir para garantizar la debida protección de la población penal femenina, con énfa-sis en las mujeres que cumplen condenas en prisión durante el embarazo y la lactancia. Se sistematizan los instrumentos del derecho internacional de los derechos humanos aplicables, destacando la Convención Americana de Derechos Humanos como están-dar regional, junto con otros tratados que se refieren a la situación de las mujeres y su condición de reclusas. El trabajo revisa las características de la población penal feme-nina en Chile y su experiencia en los centros penitenciarios, además de comparar la normativa vigente y jurisprudencia nacional, a la luz de las obligaciones impuestas al Estado a través de los tratados internacionales. El objetivo principal es analizar la legis-lación penitenciaria chilena para identificar si existen normas específicas que regulen adecuadamente la situación de las mujeres embarazadas y lactantes en prisión, y evaluar si dicha regulación cumple con los estándares internacionales para la protección de sus derechos fundamentales, garantizando su dignidad y bienestar durante el cumplimiento de sus condenas

    This text analyzes the international standards that the State of Chile must comply with to ensure the proper protection of the female prison population, with an emphasis on women who serve sentences in prison during pregnancy and breastfeed-ing. It systematizes the applicable instruments of international human rights law, high-lighting the American Convention on Human Rights as a regional standard, along with other treaties that refer to the situation of women and their status as prisoners. The work reviews the characteristics of the female prison population in Chile and their experience in penitentiary facilities, as well as compares the current regulations and national jurisprudence, considering the obligations imposed on the State through international treaties. The main objective is to analyze Chilean prison legislation to identify whether there are specific norms that adequately regulate the situation of pregnant and lactat-ing women in prison, and to evaluate such regulations to comply with international standards for the protection of their fundamental rights, guaranteeing their dignity and well-being during the fulfillment of their sentences
