Los estándares internacionales sobre derechos humanos de la niñez migrante y la opinión consultiva de la Corte Interamericana

    La creciente intensidad y diversidad de los flujos migratorios en el continente americano en la última década, ha situado al colectivo de los niños, niñas y adolescentes (NNA) migrantes en una posición de especial vulnerabilidad. Se trata de un colectivo particularmente afectado por graves violaciones a los derechos humanos en contextos de migración irregular, cuyos reclamos suelen pasar desapercibidos debido a su falta de acceso a la justicia. En este contexto, la Corte Interamericana de Derechos Humanos expidió una opinión consultiva bajo el título «Derechos y Garantías de Niñas y Niños en el contexto de la migración y/o en necesidad de protección internacional.»El artículo revisa los principales temas desarrollados en la referida opinión consultiva, incluyendo una serie de aspectos relativos a las garantías de un debido proceso en los procedimientos de inmigración, refugio y deportación de niños migrantes. Especial atención se pone a la cuestión de la detención, así como a la conexión entre interés superior del niño, vida familiar y procedimientos de deportación de niños migrantes.Además, el trabajo revisa otras iniciativas sobre la materia llevadas a cabo por el Sistema Internacional de Derechos Humanos en los últimos años, permitiendo situar a la opinión consultiva en el marco de un abordaje

    The increasing intensity and diversity of migration flows in the Americas over the last decade has placed migrant children in a position of acute vulnerability. This collective is particularly affected by grave human rights violations in contexts of irregular migration, whose complains are usually invisible due to the lack of access of justice. In this context, the Inter-American Court of Human Rights issued an Advisory Opinion entitled «Rights and Guarantees of Children in the Context of Migration and/or in need of International Protection.»This article reviews the principal topic addressed by the above mentioned Advisory Opinion, including a series of aspects concerning due process in immigration, refugee and deportation proceedings of migrant children. Special attention is given to the issue of detention, as well as to the connection between the best interests if the child, family life and deportation of migrant children.In addition, this article reviews other initiatives undertaken on this matter by the International System of Protection of Human Rights over the last years, so as to place the Advisory Opinion within the framework of a systemic approach of the topic
