The objective of the research was to analyze the Chilean immigration policy regarding the use of biometric technology, focusing on the risks it represents for the fundamental rights of irregular migrants, with the aim of evaluating whether there is protection or only control of the foreign individual. The methodology employed was documentary, using the legal dogmatic method, through the analysis of national and international regulations and doctrine. The study shows that, although biometrics has improved control and security, its improper use could violate the rights of migrants. Among the risks identified are the lack of specific regulation, the possible misuse of personal data and discrimination in decision-making processes. These problems underscore the need to balance security functions with effective guarantees for the rights of this vulnerable population.
