The author states that, at the moment of determining which are the procedural criteria in relation to the compliance claims, a dichotomy can be observed between the criteria established in the Villanueva Valverde precedent (STC No. 00168-2005-PC/TC), and the current rules of the compliance process in the New Code of Constitutional Procedure, in relation to the interpretation of paragraphs 1 to 3 of article 66 (in the New Code of Constitutional Procedure), and the current rules of the compliance process in the New Constitutional Procedural Code, in relation to the interpretation of paragraphs 1 to 3 of article 66 (in accordance with articles 6 and 24, second paragraph), in the order issued in Case No. 03966-2021-PC/TC. In this regard, he is of the opinion that such normative text obliges the constitutional judge to enter into the merits of the controversy, without further justification, to the detriment of the design of a constitutional process of conviction, of execution, brief and summary, in accordance withour Constitution and the Constitutional Procedural Code of 2004. In this way, the author explains that, in application of the exceptional power of diffuse control, any of the cited paragraphs of Article 66 of the NCPConst. can be unapplied for the specific case and other cases in which the same or similar circumstances are involved, providing for the dismissal of the compliance claims to avoid carrying out activities or procedures that are inappropriate for a specific process of urgent protection that doesnot involve or require a complex interpretative activity, with abundant evidence, to resolve the litigious matter raised.
