Viviendas de uso turístico: ¿alcanzan los artículos 17.12 y 7.3 de la Ley de Propiedad Horizontal a los locales?

    Las SSTS de 3 de octubre de 2024 han clarificado el alcance del artículo 17.12 LPH en cuando comprende la limitación en grado máximo o prohibición de la actividad de vivienda de uso turístico, lo cual ha sido confirmado por la reciente modificación de la Ley de Propiedad Horizontal, que efectúa la disposición final cuarta de la nueva Ley orgánica 1/2025, de 2 de enero, de medidas en materia de eficiencia del Servicio Público de Justicia. Sin embargo, aún quedan algunas cuestiones que necesitan ser resueltas en este ámbito, entre las que reseñamos la de si el artículo 17.12 LPH, o incluso el nuevo artículo 7.3 de esta norma, constituyen un cauce hábil para prohibir, aprobar o no autorizar la actividad de vivienda de uso turístico respecto de aquellos elementos de la división horizontal calificados como locales. Esta cuestión ha sido escasamente abordada hasta la fecha, pese a que algunas comunidades de propietarios están adoptando acuerdos de modo genérico, indistintamente, incluso comprendiendo expresamente a los locales. Sin embargo, existen determinados argumentos que arrojan dudas sobre esta posibilidad.

    The SSTS of october 3, 2024 have clarified the scope of article 17.12 LPH as it includes the maximum limitation or prohibition of the activity of housing for tourist use, which has been confirmed by the recent modification of the Horizontal Property Law, which carries out the fourth final provision of the new Organic Law 1/2025, of January 2, on measures regarding the efficiency of the Public Justice Service. However, there are still some issues that need to be resolved in this area, among which we highlight whether article 17.12 LPH, or even the new article 7.3 of this rule, constitute a suitable channel to prohibit, approve or not authorize the activity of housing for tourist use with respect to those elements of the horizontal division classified as premises. This issue has been scarcely addressed to date, despite the fact that some communities of owners are adopting agreements in a generic way, indistinctly, even expressly including premises. However, there are certain arguments that cast doubt on this possibility.
