    El presente artículo aborda como tema central la vulneración de derechos fundamentales de los afrodescendientes en el Perú. Este hecho tiene su antecedente histórico en la esclavitud, que representa fuente de la discriminación racial, el mismo que se ha reforzado por patrones socioculturales y perjuicios en la sociedad, muy arraigados en pleno siglo XXI, y que a la fecha persisten. Siendo ello así, se produce la anulación de los derechos y libertades fundamentales de dicho grupo vulnerable. En ese marco es que aparece y es una de la razones la discriminación estructural, concepto que se desprende de los pronunciamientos del Sistema Americano de los Derechos Humanos, que la abordan ampliamente en cuanto al fondo de la controversias que conocieron, para dar un matiz y resaltar la labor del Estado frente a la vulneración de sus derechos por parte de los afrodescendientes.

    This article addresses as central to the violation of fundamental rights of Afro-descendants in Perú, its historical background in slavery that represents a source of racial discrimination, the same that has been reinforced by sociocultural patterns and damages in society deeply rooted. to a full 21st century and that to date persist, this being the case, the annulment of their rights and fundamental freedoms is produced, this vulnerable group being mostly affected, that is where structural discrimination appears and is one of the reasons, a concept that emerges of the pronouncements of the American Human Rights System that broadly address it in terms of the merits of the controversies that were known, to give a nuance and highlight the work of the State against the violation of their rights by said vulnerable group, the Afro-descendant.
