Se analizan algunas de las modificaciones operadas por el Real Decreto-Ley 32/2021, de 28 de diciembre sobre la contratación temporal, concretamente: la derogación del contrato para obra o servicio determinado; el nuevo contrato indefinido adscrito a obra en el ámbito de la construcción y las modificaciones en materia de subcontratación. En relación a estas últimas, la norma posibilita la contratación de los trabajadores que prestan servicios para empresas auxiliares y en el marco de contratos interempresariales (contratas mercantiles y administrativas) en la modalidad del contrato fijo-discontinuo. Se apuntan a título orientativo algunas cuestiones que deberá abordar la negociación colectiva en el marco de la nueva regulación legal.

Some of the amendments made by Royal Decree-Law 32/2021 of 28 December on temporary contracts are analysed, specifically: the repeal of the contract for a specific work or service; the new open-ended contract assigned to work in the field of construction and amendments in the area of subcontracting. With regard to the latter, the regulation makes it possible to hire workers who provide services for auxiliary companies under the framework of inter-company contracts (commercial and administrative contracts) in the form of a fixed-discontinuous contract. As a guideline, some of the issues to be addressed by collective bargaining in the framework of the new legal regulation are outlined.
