El artículo 129 de la Constitución española de 1978 debe ser estudiado mediante una lectura ajena a orientaciones políticas y/o ideológicas parciales y acorde con los valores no de esas específicas líneas de pensamiento sino los consagrados en la propia Constitución. La lealtad constitucional en la interpretación del artículo 129 conduce a unos resultados inequívocos sobre el contenido de dicha norma, gusten o no. Partiendo de esta consideración, se analiza la amplia normativa, tanto estatal como autonómica, en materia cooperativa y que, aparte de la regulación sustantiva de estas, incorpora medidas de apoyo al cooperativismo y se valora si esas medidas son suficientes o no, tanto desde la óptica constitucional como a tenor de las estadísticas económicas. Se hace mención separada de los organismos que han sido creados de forma monográfica para el fomento de la economía social y, en particular, del cooperativismo, poniendo de manifiesto la necesidad de su replanteamiento, porque están más cercanos a posiciones gubernamentales que próximos a la ciudadanía. Además y de forma complementaria, se abordan eternas asignaturas pendientes, como la relativa a la legislación en materia educativa y que debería ser modificada para la incorporación de contenidos novedosos respecto de la economía social y el cooperativismo; o lo referente a los desempleados y la difusión gubernamental del cooperativismo, ya que centrando la atención no tanto en las medidas abstractas actualmente vigentes para el impulso de las cooperativas como en las acciones concretas de difusión del mismo, es conveniente también valorar si desde las correspondientes instancias gubernativas se está cumpliendo el aludido mandato constitucional del artículo 129 que vincula a todos los poderes públicos, entre ellos la Administración Pública en sus diversos órdenes.

The spanish Constitution of 1978 must be studied through a reading that is alien to partial political and ideological orientations and in accordance with the values consecrated in the Constitution itself. The constitutional loyalty in the interpretation of article 129 leads to unequivocal results on the content of that rule, like it or not. Based on this consideration, the broad normative, both state and autonomous, in cooperative matters is analyzed and, apart from the substantive regulation of these, it incorporates support measures for cooperativism and assesses whether these measures are sufficient or not, both from the constitutional optics. Separate mention is made of the organisms that have been created in a monographic way for the promotion of the social economy and, in particular, of cooperativism, highlighting the need for their rethinking, because they are closer to government positions than to citizens. In a complementary manner, eternal pending subjects are addressed, such as the one related to education legislation and that should be modified for the incorporation of novel contents regarding the social economy and cooperativism; or regarding the unemployed and the governmental diffusion of cooperativism, since focusing attention not so much on the abstract measures currently in force for the promotion of cooperatives, but also on the specific dissemination actions of the same, it is also advisable to assess whether from the corresponding Government bodies are fulfilling the aforementioned constitutional mandate of article 129 that binds all public authorities, including the Public Administration in its various orders.
