Resumen de La financiación ilegal de los partidos políticos: Un estudio sobre la intervención penal en la materia

La tesis elaborada centra su objeto de estudio en la financiación ilegal de los partidos políticos, en particular, en la intervención y respuesta penal en este ámbito. La principal meta que persigue el estudio es dilucidar si el Derecho penal es el instrumento adecuado para hacer frente a dicha problemática. Para lograr tal objetivo, se ha realizado un análisis desde tres perspectivas jurídicas distintas: la constitucional, la administrativa y la penal. Además, se ha examinado dicha cuestión tanto a nivel de Derecho comparado, como de Derecho español, hecho que ha permitido extraer los principales modelos normativos que a día de hoy regulan tal materia. Por supuesto, todos ellos presentan ventajas, pero también inconvenientes, de entre los cuales preocupan especialmente la falta de identificación y justificación sobre el bien jurídico protegido y el uso excesivo de la ley penal en blanco. Ante tal coyuntura, la tesis ofrece en última instancia una propuesta de regulación alternativa con la que pretende, en la mayor medida posible, superar dichos obstáculos.

The constructed PhD thesis establishes its focal point on the illegal financing of political parties, in particular, on penal intervention and response regarding this subject. The main goal pursued by the study is to elucidate whether criminal law is the appropriate means to deal with said problems. To achieve this objective, an analysis has been carried out from three different legal perspectives: constitutional, administrative and criminal. In addition, this issue has been examined both at the level of Comparative Law and Spanish Law, which has allowed to extract the main normative models that currently regulate this matter. Of course, all of them have advantages, but also disadvantages, among which the lack of identification and justification of the protected legal right and the excessive use of blank criminal law are of particular concern. Given this situation, the PhD thesis ultimately offers an alternative regulation proposal with which it intends, to the greatest possible extend, to overcome these obstacles.
