Resumen de Competition and the public buyer towards a more competition-oriented procurement system

  • Competition and the Public Buyer The main goals of this research project are i) to describe the possible distortions of competition generated by public procurement rules and practices and to set an appropriate economic framework for their analysis, ii) to evaluate the current law and jurisprudence applicable to such public distortions of competition, and iii) to propose alternative rules or remedies to help develop more pro-competitive public procurement rules and practices.

    The research departs from previous literature in this field in that it is not focused on private restraints of competition in the public procurement setting (i.e. bid rigging or abuse of a dominant position), and in that it analyses certain practices and requirements in public procurement law and practice with competition law criteria.
