La crisis del positivismo jurídico y la hermenéutica filosófica

    El presente artículo se interroga por los aportes que la actual perspectiva hermenéutica hace a la teoría jurídica, luego de lo que se ha denominado la crisis del positivismo jurídico. Para ello se hace inicialmente un recorrido por lo que es el positivismo jurídico y su crisis en la segunda mitad del siglo XX, luego se aborda las tesis más importantes de la hermenéutica filosófica de Gadamer y la influencia que éstas han tenido en la teoría del derecho actual.

    The present article is interrogated by the contributions that the present hermenéutica perspective does to the legal theory, after which has denominated the crisis of the legal positivismo. For it a route becomes initially reasonwhy it is the legal positivismoand their crisis in second half of century XX, soon approaches themost important theses of the philosophical hermenéutica of Gadamer and the influence that these have had in the theory of the present right.
