    Existe variada nomenclatura para referirse al derecho a la salud. Se sugiere referirse a este derecho simplemente como derecho a la salud. El derecho a la salud es un derecho constitucional exigible al Estado. No se trata de una mera disposición programática. El Tribunal Constitucional ha reconocido este derecho y ha afirmado su justiciabilidad. El objeto del derecho a la salud está constituido por las obligaciones que imperan sobre los destinatarios del mismo, primordialmente el Estado. Esas obligaciones son positivas y negativas. La Constitución menciona varias de ellas, pero no cabe pensar que las agota. Elproblema central es determinar cuáles son las demás obligaciones. Se sugiere tomar en cuenta las observaciones generales que ha elaborado el Comité DESC del PIDESC en relación al derecho a la salud reconocido en el artículo 12, considerando que Chile es signatario del pacto y considerando también que el Tribunal Constitucional las ha reconocido y citado

    There are diverse formulas to refer to the right to health. We suggest to refer to this right plainly as the right to health. The right to health is a constitutional right, mandatory for the State. It is not a mere programmatic provision. The Constitutional Court has recognized this right and its justiciability. The object of the right to health is constituted by those obligations that reign over the addressees of this right, particularly the State. Such obligations are both positive and negative. The Constitution mentions several of them, but it does not exhaust them. Thus, the problem consists in determining the rest of them. We suggest to consider the General Comments elaborated by the Committee of the International Covenant on Economic, Social and Cultural Rights regarding the right to health recognized in Article 12, provided that Chile has signed the pact and the Constitutional Court has recognized and cited those comments
