    Las Corporaciones locales tienen sobre sí la responsabilidad de tutelar los intereses y servicios locales para el benefi cio de los munícipes. Claro está, se parte de la premisa de que tal situación la prevé la Carta Política de cada de Estado, disposición que a su vez debe respetar el legislador común. Sin embargo, el asunto no es del todo pacífi co, principalmente debido a la lucha por el poder entre la tesis centralistas y la descentralización como doctrina contemporánea y afín a cualquier Estado Social y Democrático de Derecho, verbigracia, el costarricense.

    Así pues, este estudio parte de un breve parangón con la República de Chile, la cual dicho sea de paso, guarda aún a nuestros días, algunos resabios, infortunados por supuesto, de la dictadura del desaparecido Pinochet. Esto, aunado a la tesis centralista ha calado profundamente en el sistema jurídico de ese país suramericano.

    Local corporations bears the responsibility for safeguarding the interests and local services for the benefi t of the communes. Of course, we start from the premise that such a situation provides the Constitution of each State, a provision which in turn must respect the common legislator. However, the issue is not entirely peaceful, mainly due to the struggle for power between the central thesis and decentralization as contemporary doctrine and related to any State Social and Democratic, for instance, the Costa Rican. Thus, this study begins with a brief comparison with the Republic of Chile, which by the way, keeps even today, some remains, of course unfortunate, of the dictatorship of Pinochet disappeared.

    This, coupled with the central thesis has penetrated deeply into the legal system of the South American country.
